The following are the Terms of Use (these "Terms") that govern use of www.mauiinvitational.com (the "Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. In addition, you agree to be bound by the terms of our Purchase Policy and our Privacy Policy. The Maui Invitational reserves the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. If you violate these Terms, the Maui Invitational may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you.

Limitation of Liability

IN NO EVENT WILL THE MAUI INVITATIONAL, ITS OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS SITE OR THE SERVICES PROVIDED BY THE MAUI INVITATIONAL THROUGH THIS SITE, HOWEVER ARISING, INCLUDING DAMAGES AND IRRESPECTIVE OF ANY NOTICE PROVIDED TO THE COMPANY.
ANY LIABILITY THAT THE MAUI INVITATIONAL AND ITS OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES MAY HAVE TO YOU UNDER ANY CIRCUMSTANCES WILL BE LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT EXPENDED BY YOU WITH US DURING THE TRANSACTION GIVING RISE TO THE CLAIM; OR (B) $100. If you are a resident of a state that does not allow the exclusion or limitation of incidental or consequential damages, then the foregoing provision will not apply to you.

All notices regarding any matter pertaining to these Terms, or the policies referenced herein, including any notice of claim, summons or subpoena shall be given by first class mail or courier, postage or air bill prepaid, and sent to: KemperSports c/o Maui Invitational Tournament, 500 Skokie Blvd., Suite 444, Northbrook, Illinois 60062.

These Terms shall be construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws provisions. The Maui Invitational and you submit to the jurisdiction of the federal and state courts of Illinois and you hereby agree that any such court shall be the proper forum of the determination of any dispute arising hereunder. These Terms, as updated from time to time, constitute the entire agreement between us, with respect to the terms and conditions of use of this Site and supersedes all previous written or oral agreements between us. If any provision of these Terms are held to be invalid or unenforceable, such provision will be struck and the remaining provisions will be enforced. The section headings in these Terms are for reference purposes only and in no way limit or describe the scope of a particular section. Our failure to enforce any breach of these Terms by you or others does not mean that we have waived our right to enforce the terms of these Terms in the future for a similar breach.
